Welcome to SnapBaby!
These Terms of Service (together with all terms and conditions incorporated by reference, the "Terms") govern your use of all Snapbaby apps, websites, and services related to the SnapBaby products and services (the "Services") that are owned and operated by Snapbaby and our affiliates (collectively, "SnapBaby", "we", or "us").
These Terms constitute a legally binding agreement between SnapBaby and you, the user of the Services and/or the parent or guardian of any minor above the age of 13 whom you permit to use the Services ("you"). By using the Services, you agree to these Terms. You may not use the Services without agreeing to these Terms.
Please read these Terms CAREFULLY, as they may be updated periodically. In the event of any material changes, we will notify you through the Services and require your affirmative acceptance of the updated Terms to continue using the Service.
IMPORTANT NOTICE: These Terms contain an arbitration clause and class action waiver that govern how disputes between SnapBaby and you will be resolved. By using the Services, you agree to resolve all disputes through binding individual arbitration, which means you waive your right to a jury trial or to participate in a class action lawsuit.
User Obligations and Restrictions
When using our Services, you agree to comply with the following obligations and restrictions. Any violation of these terms may result in immediate account suspension or termination.
Security Requirements
You must not engage in any activities that could compromise, disrupt, or endanger our Services' functionality or security. Specifically prohibited actions include:
System Integrity
- Probe, scan, or test the vulnerability of our systems or networks
- Breach or circumvent any security or authentication measures
- Monitor data traffic or communications
- Access server resources without explicit authorization
Malicious Activities
- Uploading or transmitting viruses, malware, or any other malicious code
- Launching denial-of-service attacks or overwhelming our infrastructure
- Using automated systems or software to extract data from our Services ("scraping")
- Attempting to access other users' accounts or private information
Service Interference
- Interfere with or disrupt our servers or networks
- Impose an unreasonable load on our infrastructure
- Attempt to manipulate or bypass our service limitations
- Modify, reverse engineer, or decompile any part of our Services

As a user uploading content to our Services, you represent and warrant that:

- Upload and store the content on our Services
- Grant the licenses specified in these Terms
- Allow us to display and process the content as part of our Services

Cross-Platform Access
Platform Limitations: Premium features and subscriptions may be platform-specific. Your subscription on one platform (such as our website) may not automatically transfer to other platforms (such as our mobile apps).

Termination for Inactivity
- Extended periods of account inactivity (exceeding 12 months)
- Failure to maintain a valid payment method
- Non-response to critical account notifications
Termination for Service Changes
- Discontinuation of the Services
- Substantial modification of the Services
- Regional service availability changes
- Technical or operational necessity
Effects of Termination
Account Access
- Immediate revocation of access to all Services
- Deactivation of login credentials
- Removal from shared family accounts
- Cancellation of pending invitations or sharing requests
Content and Data
- Your profile information will be removed from public view
- Previously shared content may remain accessible to those you shared it with
- Personal data will be handled according to our Privacy Policy
- You may request a copy of your data within 30 days of termination
Subscriptions and Payments
- Active subscriptions will be cancelled immediately
- No refunds for unused portion of subscription periods
- Any pending transactions will be cancelled
- Outstanding payments remain due
Post-Termination Rights and Obligations
Data Retention
- We may retain certain information as required by law
- Backup copies may be kept for a limited time
- Anonymous usage data may be retained indefinitely
Legal Obligations
- All relevant terms of this agreement survive termination
- Confidentiality obligations remain in effect

Reactivation
- Terminated accounts cannot be reactivated automatically
- New account creation may be restricted
- Previous usernames may not be available
- Reactivation requests require explicit approval
User-Initiated Account Deletion
Deletion Process
- Submit deletion request through account settings

- Confirm deletion of all associated data
- Complete any pending actions or payments
Grace Period
- 30-day recovery period before permanent deletion
- Option to cancel deletion during grace period
- Automatic permanent deletion after grace period
- No recovery possible after permanent deletion
Termination Notice

- We will provide reasonable notice of termination
- Notification sent to your registered email
- In-app notification when applicable
- Explanation of termination reason when appropriate
Appeal Process
- You may appeal termination decisions

Severability
- The invalid provision will be replaced with a valid one that closely matches the original intent
- All other provisions remain in full effect
- The overall validity of the Terms is not affected

These Terms are provided in English. Any translations are for convenience only, and the English version shall prevail in case of conflicts.

Our Services provide a secure platform for storing, organizing, and sharing your child's precious moments through photos, videos, notes, and other media. Here's what you need to know about using our Services:
Age Requirements: You must be at least 13 years old to use the Services. If you're under 18, you need parent or guardian permission. Parents/guardians are legally responsible for all actions of minor users they authorize.
Permitted Use: The Services are strictly for personal, non-commercial use. Any commercial use, reproduction, or distribution is prohibited unless explicitly authorized by us in writing.
Account Security: You are responsible for maintaining the security of your account and any activities that occur under it. Use strong passwords and keep your login credentials confidential.
Account Creation and Management
When you create an account with SnapBaby, you agree to the following terms:
Accurate Information: You must provide accurate, current, and complete information during registration and keep this information updated.
Email Communications: You must provide a valid email address where we can contact you about service-related notices, including legally required notifications.
Account Types: You may create accounts for family members with appropriate permissions, but you remain responsible for all activity under these accounts.

You retain all ownership rights to the content you upload to SnapBaby ("User Content"). This includes photos, videos, text, and any other materials you share through our Services.
License Grant
By uploading content, you grant SnapBaby a limited license to store, display, and process your content solely to provide and improve our Services.

You agree not to upload content that:

Subscription and Payments
Our subscription services are structured as follows:
Pricing: We offer both free and premium features. Premium features require a subscription payment.
Payment Processing: Payments are processed through the Apple App Store's payment system. Subscription management and cancellations must be handled through your App Store account.
Refund Policy: We do not provide refunds for cancelled subscriptions. Any exceptions are at our sole discretion.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPBABY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
